Terms & Conditions
1. SUPPLY AND RETURN OF GOODS
(a) All Goods returned must be undamaged, complete, and in original packing.
(b) Returns on non-faulty Goods subject to a restocking charge at Permawise LLP’s discretion, up to a maximum of 30%.
(c) Free samples are not supplied.
(d) Permawise LLP holds the right to cancel and refund an order up until goods are delivered.
(e) Payments must be taken in advance of shipment of goods.
(f) We accept returns of non-faulty items up to 28 days after receipt of goods. Santory items (this incudes body care products) are not eligible for return once opened or unsealed in any way used for any period of time.
(g) Goods are not supplied on a trial basis.
2. DELIVERY
(a) Any delivery period is an estimate only and commences from Permawise LLP's acknowledgement.
(b) Permawise LLP shall be under no liability for delay or failure in delivery.
(c) In the event of a stock shortage Permawise LLP may deliver the Purchaser’s order in multiple consignments.
(d) Permawise LLP must be made aware of any damages that occur during transit within 14 days of consignment delivery, otherwise damaged goods will no longer be liable for refund.
3. LIMITATIONS OF LIABILITY
(a) Permawise LLP shall not be liable in contract, tort, breach of statutory duty or otherwise for any loss (consequential or otherwise), injury, destruction or damage arising out of or in connection with the supply of Goods or services by Permawise LLP.
(b) If for any reason the provisions of Condition 3(a) are of no effect in respect of a claim against Permawise LLP, Permawise LLP's liability in respect of that claim shall in no event exceed the price paid for the relevant Goods or services by the Purchaser.
(c) Permawise LLP shall not be liable for transportation and shipping costs associated with the return of products unless the aforementioned return of products is due entirely to Permawise LLP’s failure to correctly fulfill the Purchaser’s order.
4. QUOTATIONS AND ACCEPTANCE
(a) Quotations represent no obligation to accept the Purchaser's order, and are valid for thirty (30) days, or while stocks last.
(b) Price lists issued by Permawise LLP do not constitute a formal quotation and are subject to change without notice.
5. TITLE AND RISK
(a) Legal title to the Goods shall remain with Permawise LLP until such time as Permawise LLP has received payment for the price of the Goods supplied by Permawise LLP to the Purchaser, whereupon Title shall pass to the Purchaser. Insofar as Goods may be collected by or delivered to the Purchaser prior to the time when Title thereto passes to the Purchaser as aforesaid, the Purchaser shall, until such time hold the Goods as the fiduciary agent and bailee of Permawise LLP and shall remain liable to account to Permawise LLP for the Goods, or if the same shall be sold by the Purchaser (which the Purchaser shall be entitled to do as the fiduciary agent of Permawise LLP) for all the proceeds thereof without limitation.
(b) Notwithstanding the retention by Permawise LLP of legal title to the Goods (i) Risk in Goods shall pass to the Purchaser upon collection by or delivery to the Purchaser, and (ii) Permawise LLP shall be entitled to maintain an action against the Purchaser for the price of the Goods or any part thereof.
6. LIEN
Permawise LLP shall have a general lien in respect of all sums due from the Purchaser upon all Goods upon which work has been done on the Purchaser's behalf.
7. DISTANCE SELLING REGULATIONS
If the Purchaser is buying as a ‘consumer’, as defined in The Consumer Protection (Distance Selling) Regulations 2000, the Purchaser may, provided the Purchaser has taken reasonable care of the Goods, and returns the Goods complete, undamaged, and with their original packaging (including the Permawise LLP’s outer packaging), return the Goods and be repaid the price paid in respect of them within 7 working days (excluding Saturday and Sunday and any UK Bank Holiday) of their delivery. To return Goods on this basis, the Purchaser must notify Permawise LLP in writing and return the Goods, in their original packaging, within the 7 day period to “Permawise LLP, Cwrcoed-uchaf, Llangoedmor. SA43 2LG“ quoting the order number or invoice number. The Purchaser is responsible for the payment of all postage or carriage costs. The Purchaser is responsible for the care and custody of the Goods pending return or collection. Following receipt of Goods which comply with this Condition 4, Permawise LLP will refund to the Purchaser the price paid in respect of the Goods.
8. LAW
These terms and conditions are governed by the laws of England and Wales.
9. DEFINITIONS
(a) The Purchaser means the individual or company with whom the sale or supply of products or services is conducted.
(b) Invoice means the source document of Sale provided by Permawise LLP to the Purchaser, listing the Goods supplied and price charged by Permawise LLP.
(c) New Goods does not include Second Hand products, reconditioned products, or products containing second hand parts.
(d) Second Hand Goods means products or parts that have been previously purchased by a consumer, or purchased other than as stock for re-sale.
(e) Reconditioned Goods means products or parts that have been repaired or re-assembled by either (i) The Manufacturer, or (ii) Permawise LLP, subsequent to the original time of manufacture or assembly.
11. ACCEPTANCE OF TERMS
(a) All Goods and services supplied are deemed subject to sale in accordance with the above conditions, unless otherwise stated in writing.
(b) Permawise LLP's terms and conditions shall apply to the entire exclusion of those of the Purchaser, and no variation thereof shall be binding unless accepted in writing by Permawise LLP.
